California Government Structure Essays California Government Structure Essay California Government Structure Essay Structure of California’s Government Headed by the governor of the state, the state govt. of CA replicates the Federal govt. It has three branches that perform their assigned tasks and keep within the limits set by the constitution. These branches are: Legislature Executive Judiciary While this division has been created to give structure to the government and ensure its smooth and effective functioning, there is, more importantly, the need to keep the power of the branches in check and to make them accountable to each other. There is a system of ‘checks and balances’ that comes into play with this segregation of duties and separation of power. This system’s inception has been attributed to Montesquieu. (Wikipedia. org) Governor The governor is the head of the state and commander of the state’s militia, and he is the supreme executive power (ca. gov). He addresses the legislature with the state address at the beginning of the session, informing the body of the situation, the needs, and the recommendations for legislative action. He can require, by proclamation, a â€Å"special session† of the legislature to act on subjects specially specified by him. He also presents the legislature with the proposed budget and can refuse to sign a bill that can only become a law with his approval. Here again he is limited in his ‘veto’ power because he can be overridden by a two-thirds majority vote in both houses. (Capitol museum. gov) Legislature CA has a ‘bicarmel’ legislature, i. e. it has two separate legislative chambers, the Senate (40 members) and the Assembly (80 members). While the senators stand guard to the ‘liberty of the commonwealth’, the assembly members are bound to passing just laws that ‘represent and protect all the citizens of CA’. Both senators and assembly members do most of their work in committees (policy, rules, joint, special, and fiscal), and Legislators analyze, consult, debate, and hear testimony from both private and public interests on every bill. †Bicarmelism† is intended to reduce the ‘relative’ power of the legislature by having â€Å"different modes of election and different principles of action† (an argument instituted against the Seventeenth Amendment) Executive Responsible for administering and enforcing the law in the state, this branch is headed by the governor and comprises of many state departments that are headed by elected, appointed, and hired officials. Passing of a Bill To truly understand the process undergone and the roles played by the legislature and the executive to make a bill a law, let us examine the recent BILL NUMBER: AB 38 introduced on December 4, 2006, which was signed by the governor on 9/27/2008 and would become effective legislation on January 1, 2009. ( leginfo. a. gov) The actions of the senate and the assembly, hearings, debates, amendments, voting are evident in the timeline of the bill in the legislature: Signed by the Governor (executive head) of CA on September 27, 2008 PASSED THE SENATE AUGUST 21, 2008 PASSED THE ASSEMBLY AUGUST 29, 2008 AMENDED IN SENATE AUGUST 18, 2008 AMENDED IN SENATE AUGUST 11, 2008 AMENDED IN SENATE AUGUST 4, 2008 AMENDED IN SENATE JUNE 17, 2008 AMENDED IN SENATE MAY 6, 2008 AMENDED IN SENATE APRIL 14, 2008 AMENDED IN ASSEMBLY MAY 1, 2007 AMENDED IN ASSEMBLY MARCH 8, 2007 These dates and stages are a clear indication of the fact that the actual legislation is shaped and polished in the legislature, and that the executive body has little to contribute to its becoming a law. Veto power is certainly a resort, but it gives limited maneuverability to the governor. This is an example of cooperation of the two branches. â€Å"Assembly Bill 38 merges the Governors Office of Emergency Services (OES) and Office of Homeland Security (OHS) into a single, streamlined cabinet-level agency and legislation that enhances emergency assistance to disaster victims. † ( oes. ca. gov/) Gubernatorial Power California’s laws limit this power to a large extent with regard to the legislature. A study conducted by Dr. Thad Beyle (Politics in American States – Comparative Analysis) examines gubernatorial power in various areas of function in the 50 states and has compiled the data of those states for certain terms. The governor of CA has maintained a strong position in some areas while vacillating in some, or displaying a considerable decline in others. Using a scale of 1-5 in which 5 is the strongest, statistics maybe examined to see changes / typical / trends in CA 2000 to 2007 Governor’s Budget Power: 3 Governor’s Veto Power: 5 Governor’s Institutional Power: 3. 2 (3. 4 in 2000) The Governor Rating in the year 2000 placed CA’s governor at an overall rating of 3. 4 and a rank of 29 among the nation. What is interesting to note is the rating given to ‘Power of the Legislature to Change Governor’s Budget’ which was 1 on a 1 5 scale in a study conducted by Dr. Thad Beyle. This shows the CA governor as wielding a certain amount of influence in the legislature’s passing of his proposed budget, Of course, the constitution mandates that the budget be balanced and, if not, then the previous year’s budget remain effective. This already puts limitations and expectations in the budget’s formulation. Executive Order Another form of legislation is an executive order. Executive orders as issued by state governors are not laws, but do have the same binding nature. An example of specific power that is vested in the governor and that may not be overridden unless it is in conflict with the Article of the constitution is an Executive order that he can issue in case of an urgent need, Sometimes these orders may become laws. In the face of the economic crisis, drought situations, and emergencies, the governor of CA has issued several orders. ttp://www. californiaprogressreport. com/2008/07/schwarzenegger_81. html December 20, 2008 Controller John Chiang today issued the following statement in response to Governor Schwarzenegger’s executive order to implement furloughs and layoffs: â€Å"This is one of many painful results stemming from the inability of the Governor and Legislature to agree on respon sible solutions†¦. † (Giving a clear view of difference of opinion between the executive and the legislature. ) The order was implemented and the offices are closed on the 1st and 3rd Friday of every month. aliforniaprogressreport. com/2008/12/democrats_respo. html March 12, 2009 The California Universal Health Care Act is nearly identical to legislation (SB 840) that was introduced in 2007 by former Senator Sheila Kuehl. The California Legislature passed SB 840 in 2008, but it was vetoed by Governor Arnold Schwarzenegger. (This legislation would be along the lines of the Obama administration’s plans for healthcare. Here we see an excellent example of executive-legislative balance of power. To quote the governor’s response to criticism from the workers, Californians, and elected Democrats,† I have to make sure that we pay our bills and that we have the money. So, there is an executive order that I will be signing on Thursday. The governor also spurned the disapproval of the State Controller Democratic John Chiang for this order, and in reaction to the statement of Democratic State Controller John Chiang regarding the absence of the Governor’s legal authority to make this order and to have the State Controller’s Office comply with it, the Governor said, â€Å"Look, the Controller has his opinion of what he wants to do. He is a constitutional officer and he runs his office his way. I think the law is very clear that he has to follow through and do exactly what our executive order says. To seek support from the citizens. John Garamendi, California’s Democratic Lieutenant Governor wrote a letter statement asking the Governor to see it from the perspective of the workers: â€Å"I write to you today regarding the proposed executive order to reduce the minimum wage of 200,000 of Californias state workers to the federal minimum wage of $6. 5 an hour. â€Å"As you contemplate signing this executive order, please ask yourself how would you feed and care for your family on $262 per week ($1,048 per month)? How would your hardworking staff fare on these minimal earnings? Could you and your family do it for one week? â€Å"It is our duty, as elected officials of this great State, to find solutions to the many challenging problems that face California, such as the state budget. Th ose solutions should always look to improve the quality of life for all Californians, not impede it. The question arises, is this partisan decision? Are the parties pitting against each other? The answer lies in the statement issued by the Republicans in response to this position of the Governor: â€Å"Republicans understand the urgency of getting the budget done as soon as possible, which is our main focus right now. We are working very hard to avoid drastic measures like the one that is being proposed. Republicans are committed to crafting a responsible budget plan that reforms our broken system while protecting taxpayers. In this case there is a â€Å"multiple disconnect†. The executive order overrides the need for legislators to play a role, the executive body is at loggerheads at even the highest level, and the majority party does not necessarily support the governor’s decision. Based on the statistics from the past years (Dr. Thad Beyle), the governor’s b udget has almost always received a 5 on the 1-5 scale. Since this order is part of the budget, it will be interesting to note the 2009-10 Budget’s passage. Critical Viewpoint In reality, no democratic system can exist with an absolute separation of powers of the complete absence of the same. It is, therefore, a ‘principle’ that these separate bodies are established on, but their true working involves a common ground and liaison. Arguably, there is no real distinction between the two branches. An analogy has been drawn to compare the working relationship of these to that of an architect, a contractor, and an owner. Loyola Law School) The veto power is their proof in favor of this argument as it is evidence of â€Å"the executive exercising legislative power†. One might also consider the CA governor’s power to proclaim a â€Å"special session† for action on specific subjects as another form of executive ‘control’ over the legislature. In summation, the legislature has th e power and the executive branch the responsibility to ‘preserve, protect, and defend’ the laws and constitution of the United States. Being vassals of the same master they finally do overlap in their service.

German Verbs Haben (to Have) and Sein (to Be) The two most important German verbs are  haben  (to have) and  sein  (to be). As in most languages, the verb to be is one of the oldest verbs in German, and therefore one of the most irregular. The verb to have is only slightly less irregular, but no less vital to surviving speaking German. The Rules of Haben in German Well start with  haben. Look at the following table for the conjugation of  haben  in the present tense, along with sample sentences. Notice the strong resemblance to English for many forms of this verb, with most forms only one letter off from the English ( habe/have, hat/has). In the case of the familiar you (du), the German verb is identical to Old English: thou hast is du hast. Haben  is also used in some German expressions that are translated with to be in English. For example if a doctor was explaining a course of treatment to a certain individual and you could see that the individual did not understand what the doctor was telling them but the carer assumed it would be OK to let the doctor carry on and just explain the the individual later on. Where in fact you should of stopped to ask that individual if the understood and if not then ask the doctor to explain himself in a different way were they may understand more. This then includes the individual and gives them the ability to ask questions and decided what decisions they may want because they would be in the centre of their own care. If you was to wait until the individual was home to explain what the doctor was saying then they may of made the wrong choices in which path they wanted to go in simply because they did not realise what the doctor was saying and could therefore become distressed by this. For example if the individual was to agree to a type of treatment which goes against there values and beliefs but because the carer did not explain what the doctor meant they may not of known what they were agreeing to. where as by getting the doctor the explain in a understanding form for them means that they could find out all the information they need to make decisions and come away happy knowing that they fully understand what they have chosen to do. This is why person centred planning is so important because it means the individual is in charged of what they want and it makes them less distress knowing that they can make their own choices and they are being listened too and they are valued as a person.

A Message of Awareness James Joyce’s book Dubliners, is composed of several intriguing short stories. Joyce’s main emphasis is to send a â€Å"wake up call† to the people of Dublin about the appalling conditions of Ireland. In a letter to his publisher Joyce tells him that he â€Å"seriously [believes] that [the publisher] will retard the course of civilization in Ireland by preventing the Irish people from having one good look at themselves in my nicely polished looking-glass† (qtd. in Beja 33). Joyce proves his assertion through his use of characters and situations in the short stories â€Å"The Boarding House,† â€Å"A Little Cloud,† and â€Å"The Dead.† In addition, autonomy and responsibility play a major role of how the characters act and react to certain situations that connect to the hard times of Ireland. In Dubliners, characters often face situations that are portrayed as â€Å"light and dark.† In â€Å"The Boarding House,† Mrs. Mooney’s actions and interactions are primarily portrayed as being manipulative. She is a â€Å"dark† person and Joyce uses examples to support this. Joyce describes Mrs. Mooney as a person that is stern and is â€Å"all business.† Mrs. Mooney’s characteristics imply that she is someone to fear. In addition, Mrs. Mooney’s boarding house is run with much order. Joyce states that Mrs. Mooney â€Å"governed her house cunningly and firmly, knew when to give credit, when to be stern and when to let things pass,† which a viewer can acknowledge that Mrs. Mooney is a â€Å"dark† and fierce women when it comes down to taking actions on others (56). Furthermore, Mrs. Mooney has such a stern and superior control over the tenants that Joyce states that the â€Å"young men spoke of her as The madam,† which means a lady of respect (57). They know that Mrs. Mooney is one lady to be feared. In â€Å"The Boarding House,† Mr. Doran’s actions with Polly caused him to be fearful of Mrs. Mooney. Joyce explains how Mr. Doran’s feelings about receiving consequences from Mrs. Mooney are â€Å"dark.† Joyce exaggerates the depth of Mr. Doran’s nervousness towards receiving his sanctions were so fierce that â€Å"he felt his heart leap [†¦] in his throat† (61). Mr. Doran’s actions are so fearful that he acts as if he is being tried for murder. Mr. Doran’s fears of the consequences are so â€Å"dark† that He longed to ascend through the roof [of the Boarding House] and fly away to another country where he would never hear again of his trouble.

Anne Fausto-Sterling’s “The Five Sexes”

Exploring the Social Standards of Sex and Gender There are several sources that tell a person how to be a man or woman. Science tells us by recognizing the X or Y chromosomes. The media shows us through the physically ideal celebrities that grace the covers of magazines and flaunt their bodies in commercials. Sports, wrestling, cars, and blue for the boys. Dresses, make-up, painted nails, and pink for the girls. All of these sources, as well as others, have evolved into an expectation that has become institutionalized within society.This expectation, is placement and belonging into the binary system of person: the man or the woman. In Anne Fausot-Sterling's acrticles â€Å"The Five Sexes† and the â€Å"The Five Sexes, Revisited†, the binary system is exposed as being faulted. The author explores the harsh physical and psychological costs that come with the conforming to social standards. In order to understand this phenomena, an explanation of the â€Å"ideal† bo dy, and how that is determined is needed. Also, an explanation of any deviation to what is â€Å"ideal†, and how those people are treated, are important in understanding society's standards of sex and gender.Fausto-Sterling explains the ideal make-up of a man and a woman. â€Å"Males have an X and a Y chromosome, testes, a penis and all of the appropriate internal plumbing for delivering urine and semen to the outside world. They also have well-known secondary sexual characteristics, including a muscular build and facial hair. Women have two X chromosomes, ovaries, all of the internal plumbing to transport urine and ova to the outside world, a system to support pregnancy and fetal development†¦ †. (â€Å"The Five Sexes, Revisited†2). In the idealized world, Fausto-Sterling points out how human beings are a â€Å"dimorphic species†, that is, two kinds. Science takes into account the biological DNA sequence of chromosomes to determine male or female. T he genitalia of a person, his/her biological parts, are the visible factors. This is reinforced by the celebrities whose ideal bodies' are worshiped by society. But what about people who fall in between? Besides the genders male and female, there is also intersexed. Within that group of intersexed, there are subgroups.Fausto-Sterling explains this in her â€Å"The Five Sexes: Why Male and Female are Not Enough†: Firstly, the term â€Å"intersex† is used in medical literature to describe the â€Å"so-called true hermaphrodite† (possesses one testis and one ovary), â€Å"the male pseudohermaphrodite† (possess testes and some aspects of the female genitalia, but no ovaries), and â€Å"female pseudohermaphadites† (possess ovaries and some aspects of the male genitalia but lack testes). I had no idea that there were subgroups to the â€Å"intersexed†.Due to social conformity, along with the advancement of technology and surgical procedure interse xed persons are aimed to be â€Å"fixed† at birth. Although otherwise healthy, there is a need to perform surgery on the baby in order to remove certain sexual organs that don't fit with the perfect idea of what a girl or boy should look like. This often leaves scars, and the psychological and emotional confusion along with it. â€Å"The Five Sexes Revisited† focused on the importance of therapy over surgery. Medical ethicist Laurence B.McCullough of the Center for Medical Ethics and Health Policy at Baylor Collefe of Medicine in Houston, Texas â€Å"contend[ed] that in the process of assigning gender, physicians should minimize what he calls irreversible assignments: taking steps such as the surgical removal or modification of gonads or genitalia that the patient may one day want to have reversed†. (4) It is a dangerous gamble to perform â€Å"corrective† surgery and assign a sex shortly after birth because although that child may grow to accept his/her gender identity, there is no guarantee.The consequences of that gamble can cost the patient a lifetime of psychological trauma. The debate on the dangers/benefits of â€Å"corrective† surgery is strong no both sides. To argue in favor of it, one must remember how it was growing up. Children, more-so than adults, want to fit it. There really is, however, a yearning to fit in as a child growing up. As an intersexed child, fitting in would be nearly impossible because of his/her confusion of self.Sterling's insights on what pushed people to surgically alter themselves in order to comply to what society has determined to be â€Å"ideal†. The media constantly reinforces what a man should look like and what a woman should look like, and these, sometimes unrealistic, notions of ideal bodies, distorts people. It reflects how society forces people into a box, and judges anyone who do not fit into that box. These dilemmas stem from a society flawed sense of standard genders, and why a five sex system is a refreshing suggestion.Anne Fausto-Sterling's notion of a five sex system stems from the culture in which we live. There is a cultural idea that mandates that there are only two standards, man and woman, and everything in between is a deviation that needs to be fixed. In â€Å"The Five Sexes, Revisited†, Fausto-Sterling makes an analogy to the placement of intersexed and transgendered people. She says that â€Å"masculine and feminine, cannot be parsed as some kind of continuum. Rather, sex and gender are best conceptualized as points in a multidimensional space†.5) This is a fitting way to look at gender variation, unfortunately however, that is not the way society sees as the standard. This standard has been institutionalized within modern culture, and begins immediately at birth, and continues throughout life. Newborns are given a blue blanket if a boy, and a pink one if a girl. Bathrooms are either for men, or for women, with a cartoon fi gure to represent each. Passports, birth certificates, driver licenses, and other official documents, all require a declaration of male or female. There are no in-betweens.While the introduction of five sexes is certainly a noble idea, its practicality is limited. In Fausto-Sterling's â€Å"The Five Sexes Revisited†, the author postulated that 1. 7% of the general population is intersexed. That being said, introducing five sexes would call for a revamping of the infrastructures and institutions that were built on the binary system of sex and gender. The process would be costly and timely. Introducing the five sexes institutionally may seem out of reach, at least within the foreseeable future, however, its recognition certainly is not.Accepting the five sexes is progress. It can be comparable to the institutionalization of segregation in the United States. Segregation, the separation of black and white, was so embedded into the culture and laws of the United States that nobody ever imagined it would be done with. But through the determination of civil rights movements, segregation became illegal. Through the same determination, LGBQT would be able to achieve the same sense of acceptance, but it won't happen overnight, and probably not even in our lifetime.

I recently took part in 5 experiments undergoing everyday activities to see how it feels to be; ; Blind Bone density problems Hearing difficulties To have limited fine motor skills Memory loss First activity I took part In expected us to try clothes on (that required buttons) to be able to fasten the buttons wearing thick mittens and gloves. The mittens and the gloves resembled the elderly and the Limited fine motor skills (finger movements required to fasten the buttons).This task got me very frustrated as It was very difficult to fasten the buttons because as you get older your receptors become less insensitive this is linked to the fact that the brain and nervous system goes through natural changes, your brain and spinal cord lose nerve cells and weight therefore nerve cells begin to pass messages more slowly, a breakdown of nerves can affect your senses. You might have reduced or lost reflexes or sensation.This leads to problems with movement and safety. This can a ffect people's self-confidence as they may not understand their own weaknesses making it hard for them to trust themselves to do anything. The mittens and thick gloves resembled this as it was almost as if my fingers were numb and I found it hard to control them in a way I wanted to causing me feel empathy towards the elderly who do suffer with these everyday tasks.The second activity I took part in was listening to a video clip with the volume turned down, this resembled the elderly with hearing difficulties as I really had to strain to hear the smallest sound. It usually is the higher pitched sounds that seem to be harder to hear as we get older and also it is more difficult for the elderly to hear voice and conversations whilst there is background noise, I could hear the lower pitched oases such as the laughter in the background but not the detailed Information In the conversations.As you age, structures Inside the ear start to change and their functions decline. Your ability to pick up sounds decreases. You may also have problems maintaining your balance as you sit, stand, and walk. This could affect a person's self-confidence and self-Image as they may feel embarrassed If they lose balance or have to ask again for someone to repeat themselves when really It Is Just a natural occurrence that happens to us all.Linked to the sensory system controlling your senses such as hearing, sense of smell, taste and sight. The third activity I took part in required me to read a prescription and separate some elderly face, when you get older your eyesight not only adjusts more slowly to change in distances and light changes from daylight to night vision but if the prescription is hand written it could be more difficult for the elderly to read and understand also the font or printing of the prescription could have the same effect.If the elderly person is not only having eyesight difficulties but also could be prone to diseases such as Parkinson for example and might not be physically able to separate the pills onto the specific days this could be a problem as it could have a potential life risk, if they need to take pills every day and they could not be able to do so. All of the eye structures change with aging. The cornea becomes less sensitive, so injuries may not be noticed. By the time you turn 60, your pupils decrease to about one third of the size they were when you were 20.The lens becomes yellowed, less flexible, and slightly cloudy. The fat pads supporting the eyes decrease in amount and the eyes sink into their sockets. The eye muscles become less able to fully rotate the eye. The fourth activity I took part in was making Christmas cards with our eyes restricted by wearing glasses with numerous of different blockages for our eyesight, so we was completely or partially blind, we had to write the card, decorate the card and put it in the envelope.This task was particularly difficult and frustrating as it was physically impossible to do the task without messing up, as you don't know if you have already included the information or how neat it was. As we age the most common in sight difficulties is trouble focusing on something close, such as reading, writing and itching television this is called presbyters, it also gets harder to tell the colors apart but for our activity this was relevant as we tried different glasses on which reduced our eyesight to different limits.This could affect someone self-esteem as they may feel they are getting worse as they age and not feeling good enough as they once did in their younger days. The last activity I took part in was attaching heavy weights onto my arms and doing daily tasks such as brushing our teeth and brushing our hair for 2-5 minutes, we felt the strain and this resembles an elderly person who may suffer with bone density robbers most common in women after menopause, this may leave you feeling weak as when we age our muscle mass naturally decreases as our bones lose calciu m, linked to the musculoskeletal system.The decrease of muscles for an elderly person could create a serious risk for daily activities as if they fall they wouldn't be able to brace themselves properly and ease the fall as their muscles may not be strong enough to hold themselves. This could affect someone's self-esteem as they may change their own opinion of themselves may see themselves as Weak' when really the decrease of muscles begins Just after 30 years of age.

So, how do you identify rocks? You gather information about your treasure to narrow down the possibilities. Its helpful to know the hardness of your rock. Rock hounds often use the Mohs test to estimate the hardness of a sample. In this test, you scratch an unknown sample with a material of known hardness. Heres how you can perform the test yourself. Difficulty: EasyTime Required: mere seconds Heres How: Find a clean surface on the specimen to be tested.Try to scratch this surface with the point of an object of known hardness, by pressing it firmly into and across your test specimen. For example, you could try to scratch the surface with the point on a crystal of quartz (hardness of 9), the tip of a steel file (hardness about 7), the point of a piece of glass (about 6), the edge of a penny (3), or a fingernail (2.5). If your point is harder than the test specimen, you should feel it bite into the sample.Examine the sample. Is there an etched line? Use your fingernail to feel for a scratch, since sometimes a soft material will leave a mark that looks like a scratch. If the sample is scratched, then it is softer than or equal in hardness to your test material. If the unknown was not scratched, it is harder than your tester.If you are unsure of the results of the test, repeat it, using a sharp surface of the known material and a fresh surface of the unknown.Most people dont carry around examples of all ten levels of the Mohs hardness scale, but you probably have a couple of points in your possession.
